This privacy statement (“Privacy Statement”) defines how Bolatus Pharmaceuticals Ltd., a public limited company with its registered office at Bedford Street 12, Leeds, the UK, incorporated at the chamber of industry and commerce in Leeds under number 504889, operating under the name BestSarms processes, collects and uses your personal and related data.

As the security of your data is a matter of great importance to us, we act conscientiously in our handling and protection of personal data. This privacy policy (“Policy”) provides information on what personal data may be collected about you, on what legal basis it may be processed, for what purposes it is used, for how long it may be stored, and to whom it may be transmitted. The Policy also informs you of your rights related to the processing of your personal data.

1. Personal data

The GDPR (General Data Protection Regulation) defines personal data as “any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.”

1.1. The personal data we process

When you use the services of our e-shop, we process various data about you.

 1.1.1. Purchasing

The data we collect and process most often is the data you provide to us when you fill in forms so that the orders you place for products or other services on our website can be processed. This is mainly data necessary for contracting purposes.

Without it, we would be unable to process your order. This data can be structured as follows:

  1. Identifying details – your first name and surname
  2. Contact details – your email address, postal address, billing address, telephone number, bank details, and payment details.
  3. Contractual data – on the products and/or services you have ordered, and the customer segment.
1.1.2. Sign-up

In order to enjoy the benefits of our customer account, you need to sign up to our website. You log in to your account using your login details, i.e. it is protected by a password of your choice. We have no access to this password.

Benefits of a customer account:

  • After logging in, you have access to the personal profile in your account, which you can edit. 
  • Your account also lists your completed orders, your purchases, and orders in progress.

After you sign up, the following data is collected:

  1. Identifying details – your first name and surname
  2. Contact details – your email address, postal address, billing address, telephone number, bank details, and payment details
  3. Login details – your username and password
  4. Contractual data – on the products and/or services you have ordered, and the customer segment.

Registration is not mandatory – you can shop in our e-shop without it.

1.1.3. Offers

We send notifications offering products that are similar to other products you have purchased in our e-shop. You may unsubscribe from these offers at any time. To do so, use the unsubscribe link in the footer of any email containing such an offer.

When we send you an offer, we process the following data:

  1. Identifying details – your name;
  2. Contact details – your email address.
1.1.4. Using our website

When you visit our website, the following information is gathered about you: Your IP address, browser settings, and preferred language, the pages you visit and how long you spend on each page. We also track your movement around the website and the links you click on. We have a legitimate interest in customising the products and content that have been displayed to you.

When you visit our website, cookies are stored in the internet browser you use and on your device. We then read those cookies. See the “Cookies” section of this Policy.

Our website may contain links to other websites. Those websites, usually containing useful information that may be of interest to you, belong to other companies and organisations that may process your personal data on the basis of their own policies. 

We collect statistics about your use of our website, such as patterns of individual use and site-related information on usage. These statistics do not contain any personal data enabling us to draw specific conclusions about our users. After your personal data has been deleted, BestSarms may continue using anonymised data on usage for statistical analysis.

1.1.5. Participation in a campaign organised by us

The following data may be processed if you take part in a campaign organised by us:

  1.  Identifying details – your first name and surname;
  2.  Contact details – your email address.

With every campaign, you will be informed in detail of the data we are processing.

2. Purpose of processing your personal data

2.1. Shopping

Your personal data is usually processed so that our purchase contract with you can be implemented, your order can be processed, and the products you have ordered can be dispatched. Your email address and telephone number are used to send order acknowledgement, payment confirmation, invoices and other information about your order.

2.2. Customer account

If you have a customer account on our website, your personal data will be used to manage your customer account.

2.3. Offers

We send notifications offering products that are similar to other products you have purchased in our e-shop. You may unsubscribe from these offers at any time. To do so, use the unsubscribe link in the footer of any email containing such an offer.

2.4. Adjusting and creating content, improving website operation

In order to offer you products that match your interests, the personal data we collect is used to personalise the content and offers on our website. Marketing communications may also be affected by other information we have gathered on you based on your contact details, demographic profile, favourite products, and other information linked to your use of our website. Your personal data enables us to modify the content of our website and make it more user-friendly. 

Your personal data is not subject to any fully automated processing that could be legally effective for you.

Your personal data may also be processed in order to generate statistics on visitor numbers, to measure the effectiveness of advertising, or to trial new features on our website.

2.5. Services

In order to offer our customers the best possible support, we need their personal data so that we can fix any issues they may have and respond to their needs.

The personal data we collect is also used to personalise our communication with you. In this respect, we may email you to help you complete your order, process complaints, inform you of the current status of your issue, or solicit additional information from you.

2.6. Special offers and competitions

If you take part in any of our competitions, your personal data will be used to carry out the competition.

2.7. Service improvements

We need to process your personal data to improve our services and systems. The data is also used in the analyses that we conduct to improve our services. This helps to make us competitive. Most of your personal data is anonymised for these purposes. 

3.   Legal basis for the processing of your personal data

Your personal data is processed to varying degrees depending on the purpose (see above). It may be processed without your consent (on the basis of contractual performance, in order to comply with statutory obligations, or in the pursuit of our legitimate interests) or with your consent.

The method used to process your personal data depends on why it is being processed and on your relationship with us (e.g. whether you are just browsing our website or whether you are shopping with us, communicating with us, or signing up with us).

3.1. Compliance

We, as a company, must meet the obligations required of us by law. If your personal data needs to be processed for these purposes, we do not require your consent. We process your identifying and contact details, as well as information on the orders you have placed, within the scope of these legal requirements.

 3.2. Consent

Unless your personal data is processed on the basis of our legitimate interest or for contractual purposes, processing will be carried out solely on the basis of your consent (e.g. to send offers), which you may withdraw at any time.

Here, Article 6(1)(a) of the GDPR serves as the legal basis for the processing of data.

3.3. Legitimate interest

We also process your personal data if we have a legitimate interest in doing so. We have a legitimate interest, for example, in improving and personalising the services we provide to ensure that you are satisfied with the handling of your order and to promote our products and services more effectively.

Here, Article 6(1)(b) and (f) of the GDPR serves as the legal basis for the processing of data.

We also have a legitimate interest in protecting legal claims, maintaining internal records, verifying that our services are provided properly, and, unless you object to such processing of your data, engaging in direct marketing by sending notifications offering products that are similar to those you have purchased in the past.

4. Disclosure of your personal data to other recipients

In most cases, your personal data will be processed solely for our own purposes, in which case we are the “controller” of your data.

We will only pass on your personal data to our partners if this is necessary to fulfil our purchase contract with you (e.g. payment processing or shipping). Your personal data will also be communicated to our processors, who, naturally, comply with legal conditions for the protection of personal data. This will not prejudice your rights.

4.1. Recipient categories

  • Payment service companies – payment processing, fulfilment of our purchase contract with you;
  • Transport companies – delivery of the products you have ordered;
  • Product suppliers or service centres – complaint handling;
  • Operators of marketing tools – personalisation of our offers and content;
  • Providers of communication tools – customer service communications with you.

We cannot be held liable if third parties use your personal data in their own legitimate interests.

4.2. Transfer of personal data to third countries

There are certain situations in which we may transfer your personal data to third countries (i.e. countries outside the European Union) where no corresponding data protection regulations apply. These transfers will only be made if the processor undertakes to abide by the European Commission’s rules. 

5. Processing time and security of your personal data

5.1. Processing time

Your personal data will mainly be processed over the duration of our contractual relationship together (the purchase contract). Your personal data must be processed for the period required by applicable legislation for a time that is in keeping with such regulations. For example, under these legal provisions we are required to retain information about you for a certain period of time.

Validity of your consent:

The consent you give to be sent offers remains valid until it is withdrawn. 

The consent you give by submitting a product review is valid until withdrawn.

If you enter any of our competitions or take part in any of our special offers, we will process your data until requested to cease.

5.2. Security

We use SSL (Secure Socket Layer) encryption to transmit your personal data. With this system, your personal data remains secure when your browser communicates with our server. We properly secure and protect our website and other systems from the loss and destruction of your data, unauthorised access, and the alteration or dissemination of your personal data.

Your customer account can be accessed only after your chosen password has been entered. We do not have access to your password. 

6. Cookies

Cookies are a standard means of storing information on website use.

We use cookies so that our website and our offers are relevant, interesting and user-friendly for you. Cookies should therefore be enabled in your browser. How long cookies remain in your browser or device depends on the settings of the cookies themselves and on your browser settings.

You can configure cookie settings in your browser. By default, most browsers are set to automatically accept cookies. You can either refuse cookies altogether or limit them to selected types. However, this restricts the way our website works (including logging in to your customer account).

Just as we have rights and obligations in the processing of your personal data, you too have certain rights enshrined in the GDPR that you can exercise.

7.1. Right to information

You have the right to information about the processing of your personal data. See Article 15 of the GDPR.

7.2. Right to rectification

If you discover that the personal data processed about you is incorrect or incomplete, you have the right to immediately request the correction of that data. See Article 16 of the GDPR.

7.3. Right to erasure

In certain cases, you may request the immediate erasure of your personal data. See Article 17 of the GDPR.

7.4. Right to restriction of processing

In certain cases, you may exercise the right to restrict our processing of your personal data. See Article 18 of the GDPR.

7.5. Right to data portability

You have the right to receive from us, in a structured, machine-readable format, all personal data you have provided to us. See Article 20 of the GDPR.

7.6. Right to object

You have the right to object, at any time, to the processing of your personal data for reasons related to your specific circumstances. See Article 21 of the GDPR.

7.7. Right to lodge a complaint

Without prejudice to any other administrative or judicial remedies, you have the right to lodge a complaint with a supervisory authority. See Article 77 of the GDPR.
